1. THESE TERMS

1.1 What these terms cover. These are the terms and conditions on which we supply services.

1.2 Why you should read them. Please read these terms carefully before you submit your reservation. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

2. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Who we are. We are Charlie, and Julia Hutchings. We are a partnership trading as The Granary, Larkbeare Grange. Our address is The Granary, Larkbeare Grange, Talaton, Exeter, Devon, EX5 2RY.

2.2 How to contact us. You can contact us by using any of the details contained on our Contact Us page.

2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when making your reservation.

2.4 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes email but not fax.

3. OUR CONTACT WITH YOU

3.1 How to place your reservation. You can place a reservation by contacting us using the details available on our Contact Us page.

3.2 How we will accept your reservation. Our acceptance of your reservation will take place when we email you to accept it, at which point a contract will come into existence between you and us. Please note we will only email you to confirm the reservation once we are in receipt of the Deposit (as defined in clause 7).

3.3 If we cannot accept your reservation. If we are unable to accept your reservation, we will inform you of this in writing and will not charge you. No contract will be formed between you and us in this circumstance.

4. YOUR RESERVATION

4.1 Arrival date and Departure. We will confirm your arrival and departure time and date in our confirmation email when we accept your reservation. Please note that we accept arrivals after 4:30pm but please let us know in advance when you plan to arrive. Check-out is by 9.30am on the day of departure. Should you require access to The Granary outside these times, please Contact Us to discuss.

4.2 Reservation Age Limit. We do not accept reservations from those under the age of 21 years or where the majority of members are younger than 21 years (with the exception of families).

4.3 Information regarding the local area. Any information regarding the local area that may be shown on our Website is outside our control and is not supplied by us. Whilst we endeavour to keep this information up to date we cannot guarantee that it is accurate.

4.4 Internet availability. Wireless internet access is offered without additional charge for your use on the basis that we cannot promise that the service will be available constantly and that it is provided for recreational and not for business use. Neither a minimum speed, unrestricted bandwidth nor uninterrupted provision of an internet access service can be guaranteed. We will not be liable for any claim in respect of the provision of internet services or telephone services not being available or failing. You agree to reasonable and lawful usage of this service.

5. THE GRANARY SPECIFIC RULES

You must adhere to The Granary rules. There are specific rules in place for The Granary that you must adhere to. These rules are as follows:

5.1.1 The number of occupants. The Granary must not exceed five occupants at any time. Please note, babies in a cot are not normally counted as members of a party.

5.1.2 Responsibility for occupants. The individual who we contract with (who made the reservation) will be responsible for all persons staying in The Granary and should ensure that they are aware of these rules as set out in this clause. Children must be supervised at all times.

5.1.3 The Granary Condition. You are responsible for leaving The Granary in good order and in a clean condition. If further cleaning is required an additional cleaning charge will be levied.

5.1.4 Flooring. The Granary has oak floors that are treated with a natural oil. As such please do not wear footwear with high/stiletto heels or anything which could cause damage to the floors and ensure any spillages are cleaned immediately.

5.1.5 Flammables. The Granary is a timber structure as such no traditional candles or other flammable items are allowed. When using the BBQ, please ensure it is not on the decked area.

5.1.6 Smoking. The Granary is a no smoking property and as such no smoking or vaping is permitted.

5.1.7 Telephone Usage. All telephone calls made using the landline during your stay are charged at cost plus 20%. Alternatively, there is a reasonably good mobile signal and wireless internet access provided without charge.

5.1.8 Dogs. We accept reservations with up to two dogs at a charge of £30 per dog per week or part thereof. We ask that you are considerate of our neighbours in the nearby properties and ask that:
(a) you keep your dog(s) on a lead when around The Granary site;
(b) please review The Countryside Code and ensure that your dog(s) do not chase any livestock or wildlife or enter into any fields where there is livestock;
(c) dogs are not allowed in the bedrooms or on the furniture of The Granary and must not be left alone in The Granary. We reserve the right to charge for extra cleaning where dogs have been on the beds or on the furniture;
and
(d) if your dog is muddy from a walk we ask that you please clean them off using the outside tap/shower and the dog towel provided. Please on no account use the towels provided for your use. We will provide a separate towel marked accordingly.

5.1.9 Linen/Towels. We provide bed linen, together with bath and hand towels within the reservation charge. If you require a linen change within a seven-day period there will be a charge of £20 per bed. Please give us advance notice. If your stay is for two weeks there will be a mid-stay change of linen for no additional charge.

5.1.10 Fireplace. The Granary contains a bioethanol fire which will be filled prior to your arrival. We have refills available for £7 each.

5.1.11 Garden and pond. The Granary has its own enclosed garden for your use. All other garden areas belong to the adjacent properties and therefore we ask that you respect the privacy of the neighbouring guests. The pond is not fenced and as such you must supervise children and pets at all times.

5.1.12 Neighbouring Properties. The Granary has nearby properties, therefore we request that you are respectful of our neighbours and keep all noise to a minimum.

5.1.13 Access to The Granary. You must allow us reasonable access to The Granary if necessary.

6. YOUR RIGHTS TO MAKE CHANGES

To make changes to your reservation. If you wish to make a change to the reservation you have placed please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the reservation or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change, or the consequences of making the change are unacceptable to you, you may want to end the contract.

7. PRICE AND PAYMENT

7.1 Where to find the price for the reservation. The price of the reservation (including VAT where applicable) will be the price confirmed to you when you contact us.

7.2 We require a Deposit to secure the reservation. You have three days from entering your reservation request, to pay a non-refundable deposit of 50% of the total reservation price (the Deposit).

7.3 Payment of remaining balance. Once the Deposit has been paid, the remaining balance will be due eight weeks prior to your scheduled arrival date as indicated on our confirmation email. Please note that if you are making a reservation within eight weeks of your scheduled arrival date we will require a full payment upon reservation.

7.4 We may offer special offers and/or discounted rates. Any special offers and discounted rates are subject to availability when bookings are made direct with us. Such offers and discounts cannot be applied to existing reservations.

7.5 We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date of your reservation, we will adjust the rate of VAT that you pay.

7.6 What happens if the price is wrong. It is always possible that, despite our best efforts, some of the reservation rates may be incorrectly priced. We will normally check prices before accepting your reservation so that, where the reservation’s correct price is less than our stated price, we will charge the lower amount. If the reservation’s correct price is higher than the price stated to you, we will contact you for your instructions before we accept your reservation.

7.7 How you must pay. We accept payment by bank transfer Bank: Virgin Money Sort Code: 821208 Account Number: 50105658; in the name of The Granary, Larkbeare Grange. This is a business account. If your bank does not recognise a match on this account, we suggest you initially send £10 and we will acknowledge safe receipt.

7.8 We do not require a damage deposit. If you damage something during your stay with us, please let us know. If the damaged item requires repair or replacement we reserve the right to charge you the cost incurred by us in repairing or replacing the item.

7.9 Electric Vehicle (EV) charging point. This is available for guests’ use only, for which there is a charge. Please let us know when you would like to use it so we can explain the best place to park.

8. CANCELLATION

8.1 Cancelling a reservation. If you cancel your reservation you will not receive a refund of any monies paid to us at the time of cancellation unless we are able to re-let The Granary (see clause 8.2). The more notice of your cancellation you give us, the more likely it is that we are able to re-let The Granary and provide you with a refund.

8.2 If you cancel your reservation and we are able to re-let The Granary we may refund any monies you have paid (up to the value the re-letting permits, less our reasonable administrative costs)..

8.3 Our right to cancel a reservation. We reserve the right to cancel any reservation at any point where you or your occupants have not complied with these conditions.

9. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

9.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the
reservation process.

9.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services.

9.3 We are not liable for business losses. We only provide accommodation for private use. If you use the accommodation for any business or commercial purpose we will have no liability to you for any loss including; loss of profit, loss of business, business interruption, or loss of business opportunity.

10. HOW WE MAY USE YOUR PERSONAL INFORMATION

How we may use your personal information. We will only use your personal information as set out in our Privacy Policy.

11. EVENTS OUTSIDE OF OUR CONTROL

11.1 Failure to perform obligations due to an event outside of control. We shall not be in breach of these terms, nor liable for delay in performing, or failure to perform, any of our obligations under these terms if such delay or failure results from events outside our control.

11.2 Examples of events outside our control. An event outside of control includes, but is not limited to; strike, civil unrest, civil emergencies, government prohibition or restriction on all or part of the economy or trade, pandemic, epidemic, environmental disaster, utilities failure or interruption, adverse weather conditions (but only where The MET Office issues a severe weather warning).

12. INSURANCE

We recommend that you take out your own holiday insurance at the time you place your reservation. For the avoidance of doubt, we do not arrange insurance on your behalf and insurance is not included within your reservation.

13. OTHER IMPORTANT TERMS

13.1 We may transfer this Agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this. If you are unhappy with the transfer you may contact us to end the contract within a month of us telling you about it.

13.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

13.3 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

13.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

13.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

13.6 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the services in either the Northern Irish or the English courts.
